Terms of Service

PumpkinMorph is operated by ZIHANG LIU, an individual operator based in Mainland China ("PumpkinMorph," "we," "us," or "our"). These Terms govern your use of the AI-powered photo-to-video service at pumpkinmorph.com.

By creating an account, buying credits, uploading media, or using the service, you confirm that you are at least 18 years old and agree to these Terms, our Privacy Policy, Acceptable Use Policy, and Refund Policy.

1. The service

PumpkinMorph is a digital software service that turns authorized photos into short, AI-generated Halloween videos, including pumpkin-head effects, costume transitions, simple reveals, and pet combinations. Digital access is delivered immediately after payment and successful generation.

Video generation currently uses MiniMax H3 Max and MiniMax H3 Max Turbo models delivered through fal.ai. Availability, processing time, and output quality may be affected by these third-party providers. PumpkinMorph is independently operated and is not endorsed by those model or infrastructure providers.

2. Accounts and security

• You must provide an accurate email address and keep access to it secure.
• You are responsible for activity performed through your account.
• Contact us promptly if you suspect unauthorized use.
• We may suspend accounts involved in fraud, abuse, chargeback misuse, or policy violations.

3. Credits, pricing, and payment

• Current prices and included credits are shown publicly on the Pricing page.
• All currently offered credit packs are one-time purchases. There is no automatic renewal.
• Each successful standard video uses 10 credits.
• Purchased credits do not expire while the account remains active.
• A failed generation automatically returns the reserved credits to the account.
• Taxes may be calculated and collected at checkout where required.

Payments may be processed by Waffo Pancake, acting as merchant of record, or by another payment provider shown at checkout. PumpkinMorph does not store complete card numbers. The merchant descriptor shown on a statement or receipt is PumpkinMorphor the descriptor displayed during checkout.

4. Refunds

Unused credit packs may be refunded when requested within 7 days of purchase. Credits that have been used for a successful generation are non-refundable, except where law requires otherwise. Duplicate charges and confirmed billing errors are eligible for a full refund. Full details and request instructions are in our Refund Policy.

5. Your photos and permission

You may upload only media that belongs to you or for which you have explicit permission from every identifiable person depicted. Before continuing from an upload screen, you must actively confirm that permission. Do not upload a child's image unless you are the parent or legal guardian and the use is lawful.

Permission to use a photo does not permit impersonation, deceptive deepfakes, sexual or intimate composites, fabricated statements, harassment, or any other prohibited use.

6. Inputs, outputs, and intellectual property

You retain your rights in the media you upload. You grant us and our service providers a limited, non-exclusive license to process that media only to provide, secure, and support the requested service. Subject to applicable law and third-party rights, you may use your generated output for lawful personal or commercial purposes.

AI output may contain artifacts, inaccuracies, or unexpected results. You are responsible for reviewing an output before publishing it and for labeling it as AI-generated where required. We do not guarantee that an output will meet a particular creative expectation.

7. Acceptable use and safety

You must follow our Acceptable Use Policy. Prohibited uses include pornography or NSFW material, violence or gore, hate content, child-unsafe content, deepfakes or impersonation, and copyright or trademark infringement. We may block a request, remove content, forfeit credits associated with abuse, suspend an account, or report unlawful activity where appropriate.

8. Privacy and service providers

Our Privacy Policy explains our data practices. Necessary providers include Cloudflare for hosting and database services, Resend for login email, Waffo Pancake and/or PayPal for payment, and fal.ai/MiniMax for AI video generation.

9. Availability and liability

The service is provided "as is" and "as available." To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages. Our total liability relating to the service will not exceed the amount you paid during the 12 months before the event giving rise to the claim. Nothing in these Terms limits rights or liabilities that cannot lawfully be limited.

10. Suspension, termination, and changes

You may request account deletion by contacting support. We may restrict or terminate an account for material breach, fraud, unlawful conduct, or safety risk. We may update these Terms; material changes will be announced by email or on the service before taking effect.

11. Governing law and contact

These Terms are governed by the laws applicable in Mainland China, without limiting any mandatory consumer protections available in your country. Please contact us first so we can try to resolve any billing or service dispute informally.
